I. WHAT IS ENVIRONMENTAL RECORDS?
In Vietnam, the process of industrialization and modernization of the country is growing rapidly with many companies, enterprises, and manufacturing plants being opened to attract many domestic and foreign investors. Industrial zones were opened throughout the provinces with many factories producing all kinds of industries such as: textiles, dyeing, plating, steel and metal, food, pharmaceuticals, cosmetics, paper and packaging, …
Before putting a factory or business into operation, investors must complete many related procedures and papers such as applying for an investment certificate, registering for business establishment, applying for a license build.
In addition, because the production and business process of enterprises may have negative impacts on the environment, some objects and projects are specified in Appendix II to Decree No. 18/2015/ND-CP of the Government must complete the implementation of legal documents on the environment. These documentation procedures should be performed during the project preparation phase.
According to Article 3 of the Law on Environmental Protection 2014, environmental records is a collection of documents on the environment that agencies, organizations and enterprises must comply with the provisions of law. The purpose of environmental records is to help companies, businesses, and factories to comply with regulations on environmental protection, to ensure that the project operates without being fined, without violating regulations, state policy on environmental protection.

In order for customers to better understand the environmental records as well as related legal procedures, Hoa Phat Eco would like to share all the latest knowledge about the latest environmental records in 2022 as follows:
1. ENVIRONMENTAL RECORDS FOR COMPANIES THAT HAVE NOT BEEN OPERATED
For enterprises, before going into production and business activities, it is necessary to carry out one of the following environmental records:

Environmental Impact Assessment Report (also called ĐTM):
Implementation for projects of enterprises and establishments with large production scale specified in Appendix II of Decree No. 40/2019/ND-CP dated May 13, 2019 amending and supplementing some Article of Decree No. 18/2015/ND-CP dated February 14, 2015, stipulating environmental protection planning, strategic environmental assessment, environmental impact assessment and environmental protection plan.

Environmental Protection Plan (formerly name as Environmental Protection Commitment):
Applied to new investment projects, investment in scale-up and capacity increase, which are specified in Column 5, Appendix II of Decree No. 40/2019/ND-CP Decree amending and supplementing a number of regulations. Articles of decrees detailing the implementation of the Law on Environmental Protection issued on May 13, 2019.

Report on completion of environmental protection works
Applies to projects subjects specified in Column 4, Appendix II of Decree 40/2019/ND-CP Decree amending and supplementing a number of articles of decrees detailing the implementation of the Law on Protection environment issued on 13/05/2019. Implementation time: after completing the environmental protection works committed in the previously approved Environmental Impact Assessment Report.
2. ENVIRONMENTAL RECORDS FOR BUSINESSES OPERATED
After going into operation, establishments and businesses that have not yet prepared one of two dossiers: Environmental Impact Assessment Report (ĐTM) or Environmental Protection Plan (Environmental Protection Plan), must proceed Make one of the following two documents:

Report on results of periodic environmental monitoring (formerly name as Periodic Environmental Monitoring Report):
Report on environmental monitoring results is a form of short-term assessment of environmental quality at enterprises and periodic reports to competent authorities (namely: Sub-Department of Environmental Protection; Department of Natural Resources and Environment) (Department of Natural Resources and Environment). Legal basis for making environmental monitoring reports: Decree 40/2019/ND-CP, Circular 25/2019/TT-BTNMT, environmental monitoring program approved in the DTM/ Environmental Protection Plan/ Scheme environmental protection).
For environmental quality monitoring, enterprises need to choose certified environmental analysis centers that are qualified to operate or environmental consulting companies that have a contract to cooperate with the analysis center. The process of making an Environmental Protection Report is as follows:
- Quarterly environmental monitoring according to regulations
- Collecting documents, information and data on production and business activities in 1 year
- Summarize results of environmental monitoring, tabulate and compare with current standards
- Evaluation of the treatment efficiency of waste treatment works
- Synthesize and check waste handover records and hazardous waste documents
- Synthesize information, make reports and submit to specialized agencies.
Regarding the period of periodical monitoring: the environmental monitoring needs to be carried out quarterly (Quarters 1, 2, 3, 4). Then, based on these results, they will be compiled into the Environmental Monitoring Report. Depending on the region, this report can be made 4 times/year, 2 times/year or once/year.

Dossier for registration of waste source owner book:
Applicable to all businesses and establishments that generate hazardous waste.
Subjects must implement the hazardous waste source owner book:
– For production, business and service establishments that generate hazardous wastes > 600 kg/year, they are required to establish a hazardous waste source owner book according to Circular 36/2015/TT-BTNMT on Quality Management hazardous waste.
Subjects to make the first hazardous waste management report:
– Hazardous waste-generating establishments have an operation period of not more than 01 year.
– Establishments generating hazardous wastes regularly or annually with a total quantity not exceeding 600 kg/year, except for hazardous wastes on the list of persistent organic pollutants (POPs) as prescribed in the Stockholm Convention on non-biodegradable organic matter.
– Offshore oil and gas facilities.

Discharge permits:
Applicable to businesses that generate wastewater and discharge waste into the environment. And applies to establishments operating in Vietnam with activities related to discharge of waste into receiving water sources > 5 m3/day.night according to Decree 201/2013/ND-CP detailing implement a number of articles of the Law on Water Resources and < 5 m3/day.night for industrial production establishments that are at risk of causing serious environmental pollution.

Records of groundwater extraction:
Implementation with establishments operating in Vietnam with activities related to groundwater extraction > 10 m3/day.night according to Decree 201/2013/ND-CP detailing the implementation of a number of articles of the Law on Water Resources.

Contract for transportation and treatment of hazardous waste (HW)
Applicable to production, business and service establishments that generate hazardous wastes, collectively referred to as hazardous waste generators, must sign a contract to transfer hazardous wastes with organizations or individuals that have a license to practice management of hazardous wastes.
